Terms of Service
These Terms govern your access to and use of the Tryonixs virtual try-on platform, SDK, dashboard, and related services.
Last updated:
1. Acceptance of Terms
By creating an account, accessing our website, embedding the Tryonixs SDK, or otherwise using our services, you agree to these Terms of Service ("Terms"). If you use Tryonixs on behalf of a company or organization, you represent that you have authority to bind that entity.
If you do not agree to these Terms, do not use Tryonixs.
2. Description of Service
Tryonixs provides browser-based augmented reality and virtual try-on software for e-commerce merchants, including eyewear, foundation, and lipstick try-on experiences, a merchant dashboard, analytics, API keys, and integration tools for platforms such as Shopify and WooCommerce.
We may update, modify, or discontinue features of the service at any time. We will use reasonable efforts to notify account holders of material changes that affect paid plans.
3. Accounts and Registration
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account.
You may sign up using email and password or supported third-party authentication providers (such as Google). You must be at least 18 years old, or the age of majority in your jurisdiction, to create a merchant account.
4. Acceptable Use
You agree not to:
- Use Tryonixs for unlawful, deceptive, or abusive purposes.
- Attempt to reverse engineer, scrape, overload, or disrupt the platform or SDK.
- Upload malicious code, infringing content, or product assets you do not have rights to use.
- Misrepresent Tryonixs branding except as permitted by your plan.
- Circumvent plan limits, domain allowlists, API restrictions, or security controls.
- Use the service in a way that violates applicable privacy, biometric, or consumer protection laws.
5. Camera Access and Virtual Try-On
Virtual try-on features require camera access in the end user's browser. Merchants are responsible for providing appropriate notice and obtaining any required consent from shoppers before enabling try-on on their storefronts.
Tryonixs is designed so that face tracking and product overlay processing occur on the shopper's device where supported. Merchants remain responsible for their own storefront privacy disclosures and compliance obligations.
6. Plans, Billing, and Payment
Tryonixs offers Starter, Pro, and Custom plans as described on our pricing page. Plan limits (such as product counts and try-on usage) apply according to your active subscription.
Prices, discounts, and plan features may change. We will apply pricing changes to new subscriptions or renewals after reasonable notice where required. Custom and enterprise arrangements are governed by separate written agreements when applicable.
Unless otherwise stated, fees are quoted in U.S. dollars. You are responsible for applicable taxes.
7. Merchant Content and Product Assets
You retain ownership of product images, frame assets, shade data, and other content you upload or configure in Tryonixs.
You grant Tryonixs a limited license to host, process, transmit, and display your content solely to provide and improve the service, support integrations, and generate analytics you configure.
You represent that you have all rights necessary to use and display merchant content through virtual try-on on your storefront.
8. Tryonixs Intellectual Property
Tryonixs, including its software, SDK, documentation, branding, and website content, is owned by Tryonixs and its licensors and is protected by intellectual property laws.
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable license to use the SDK and dashboard for your internal business purposes and authorized domains.
9. Disclaimers
Tryonixs is provided on an "as is" and "as available" basis. Virtual try-on previews are visual approximations and may vary based on device, lighting, camera quality, and product assets. We do not guarantee fit, shade accuracy, or purchase outcomes.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Tryonixs. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising from your use of the service.
Our total liability for any claim relating to the service will not exceed the amount you paid to Tryonixs in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars (USD $100) if you use a free or trial tier.
11. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create security or legal risk, or fail to pay applicable fees.
You may stop using Tryonixs at any time. Upon termination, your right to use the service ends, but sections that by nature should survive (including intellectual property, disclaimers, and limitations of liability) will remain in effect.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may also be communicated by email or in-dashboard notice.
Continued use of Tryonixs after changes become effective constitutes acceptance of the updated Terms.
